Temaro is provided by Temaro LLC, an Arkansas limited liability company (“Temaro”, “we”, “us”). By signing up for or using Temaro, you agree to these terms in full.
You must be at least 18 years old and able to form a binding contract to use Temaro.
Temaro provides communication and job-management software for local service businesses — including missed-call auto-texting, review requests, win-back check-ins, project intake forms, quotes and invoices (delivered by text or email), online payment collection through Stripe, appointment scheduling, a crew schedule for your team, measuring tools, and two-way text messaging with your customers. You are responsible for ensuring your own customers have properly consented to receive automated text messages, and for the accuracy of information you enter into the platform. Temaro is under continuous development; features, limits, and functionality may be added, changed, or removed at any time, and we do not guarantee that any specific feature will remain available indefinitely.
A valid payment method is required at signup, and you are charged immediately for your selected tier (Starter, Standard, or AI Pro). Your subscription then bills automatically each month at that rate until canceled. You can manage or cancel your subscription, or switch tiers, at any time through your account settings. Fees are non-refundable except where required by law. We may change our pricing or fees at any time; if we do, we'll give you at least 30 days' notice before the change applies to your account.
Your business phone number. Your dedicated business number is provided to you for as long as your subscription is active. If your subscription is cancelled, the number is placed on hold for 30 days: it stops sending, but it is kept for you, and restarting your subscription within those 30 days restores it unchanged. We will remind you about a week before the hold ends. After 30 days without an active subscription, the number is released back to our telephone carrier, which may reassign it. A new subscription after that point receives a new local number. Your data is not deleted when a subscription lapses — only when you delete your account (see below).
Mobile carriers require every business that sends text messages to be registered and approved. By setting up texting, you authorize Temaro to register your business with Twilio, The Campaign Registry and the mobile carriers on your behalf, using the details you give us, and to publish a page for your business on temaro.io — with its own privacy notice and texting terms — that shows your customers how they opt in. You confirm that those details are true and accurate and that you are authorized to register the business; details that don't match public records are the most common reason a registration is rejected. Texting under your own registration starts once the carriers approve it. That usually takes under a week and sometimes up to three; approval is the carriers' decision, and we can't guarantee it or how long it takes. Temaro pays the registration and vetting fees. If a registration is rejected, we show you the reason and help you correct it and send it back for review.
You can buy additional texts, and on the AI Pro plan additional AI actions, as one-time top-up packs from Settings → Billing at the prices shown there. Packs are charged to your card when you buy them and are added to your account's allowance. Each month your plan's own included amount is used first; anything beyond it comes out of your packs, oldest first. Unused pack amounts roll over from month to month and expire twelve months after purchase. Packs do not change your plan, and an AI pack can only be used on a plan that includes AI. Like subscription fees, pack purchases are non-refundable except where required by law; if a pack is refunded, whatever remains on it is removed from your account.
If you turn on online payments, your customers can pay deposits and invoices by card — and, unless you switch it off, by bank account — through Stripe, Temaro's payment processor. To receive that money you connect a Stripe account in your business's name, and Stripe's agreement for connected accounts applies to it. Each card payment is processed through Temaro's own Stripe platform account and made on your business's behalf: your business is the settlement merchant (in everyday terms, the merchant of record) for the payment, and your business name appears on your customer's card statement. Stripe passes the money on to your connected Stripe account straight away, less the two fees below, and pays it out to your bank on your Stripe account's payout schedule. Two fees come out of each payment collected this way, deducted automatically: Stripe's card processing fee (Stripe charges it to Temaro for each payment, and Temaro passes it on at cost; it is currently 2.9% + 30¢ per payment for US cards, as set by Stripe), and Temaro's own platform fee of 0.3% of the payment. We will give you at least 30 days' notice before changing Temaro's rate; if Stripe changes its card price, the fee passed on changes with it and we will tell you. Neither you nor Temaro ever sees your customer's card number or bank account number.
Bank account payments. A customer can also pay from their US bank account (an ACH debit), once Stripe has switched bank payments on for your account; you can turn this off in Settings → Online payments. Stripe's fee for a bank payment is currently 0.8% of the payment, never more than $5, passed on at cost in the same way, plus Temaro's 0.3%. A bank payment usually takes about 4 business days to clear. Until it clears, Temaro shows it as on the way, not paid — the invoice or deposit is not marked paid until it clears, and while it is on the way it cannot be paid again, edited or cancelled. A bank payment can still fail after the customer has made it (for example, if the account doesn't have enough money); if it does, we tell you and the invoice or deposit is open to be paid again. A customer can also dispute a bank payment with their bank, and the disputes terms below apply to it as they do to a card payment.
Refunds. Because these payments are processed through Temaro's platform account, a refund is issued from there too: you start it from the invoice or quote in Temaro, the customer is refunded, and the same amount is taken back from what was sent to your Stripe account, with the matching share of the fees taken from that payment returned. Whether a refund is owed is between you and your customer.
Disputes and chargebacks. If a customer disputes a card or bank payment with their bank, Stripe takes the disputed amount from Temaro's platform account. We will tell you, and we answer the bank for you using the proof of the work you send us (photos, the accepted quote, your messages with the customer). If the dispute is lost, you authorize Temaro to take the disputed amount back from what was sent to your Stripe account. If that can't be done automatically — for example because the money has already been paid out of your Stripe account — you agree to repay it to Temaro. Disagreements about the work itself remain between you and your customer.
Temaro records what was paid, refunded and disputed so your quotes and invoices stay accurate; if a payment arrives for a different amount than the quote or invoice asks for, we do not mark it paid and instead flag it for you to review. You are responsible for any tax owed on payments you collect.
You can delete your account at any time from Settings. Deletion takes effect immediately: automated texts and calls stop, your intake form closes, any quote or invoice links you have already sent stop working, payment pages your customers already have open are closed, and nobody on your team can sign in. We cancel your subscription with our payment processor at the same moment; if that can't be confirmed straight away, we keep trying every hour and email you once it is. If you are charged after you asked to delete your account, contact admin@temaro.io.
For 30 days after you delete, nothing is erased. Your data and your dedicated phone number are held, and you can sign in and restore the account exactly as you left it. Restoring does not restart your subscription automatically — you will be asked to choose a plan again before you can use the service.
After 30 days, your account and its data are permanently deleted and cannot be recovered, except the limited payment records our Privacy Policy describes, which we keep to finish refunds, disputes and amounts owed and to meet our own legal and accounting obligations. Your dedicated phone number is released back to our telephone carrier, which may reassign it to someone else.
You may not use Temaro to send messages to anyone who has not consented to receive them, to send unlawful, harassing, deceptive, or misleading content, or to use the service in any way that violates telecommunications regulations (including TCPA requirements), applicable consumer protection law, or any other applicable law. You also may not: attempt to reverse-engineer, copy, or resell the platform; interfere with or disrupt the service's security or infrastructure; use the service to build a competing product; or attempt to circumvent any usage limits, rate limits, or account restrictions we put in place. We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, as described below.
Temaro is a tool that helps you communicate with your customers — it is not a substitute for your own legal compliance. You are solely responsible for determining what consent, disclosures, and recordkeeping are required under the TCPA, state telemarketing and call-recording laws, and any other law that applies to your business and the jurisdictions where your customers are located, and for obtaining and documenting any consent required before contacting them. Features like consent tracking and opt-out handling are provided as a convenience to help you operate compliantly; they are not a guarantee of legal compliance, and Temaro does not provide legal advice. If you are unsure what the law requires for your business, consult your own attorney.
This applies with particular force to messages you write yourself. Temaro lets you and anyone you have authorised send individual text messages to your customers. You are responsible for the content of those messages and for having the right to send them. Where Temaro can tell that a customer has not consented and has not contacted you first, it will warn you before sending — but choosing to send anyway is your decision and your liability, not ours. Temaro will refuse to send to anyone who has replied STOP, and neither you nor we can override that; only the customer can, by replying START.
You are also responsible for who you give this ability to. Permission to send texts is off by default for team members and can only be granted by the account owner. Messages sent by anyone on your team are your responsibility under these Terms as though you had sent them yourself.
Temaro LLC operates a text messaging program on behalf of the home-service businesses that use Temaro. If you are a customer of one of those businesses, these terms apply to the text messages you receive from that business's Temaro number. These texting terms apply only if you choose to receive texts: agreeing to receive texts is never required to use a business's services, send its form, get a quote or book a visit. The full program details are at temaro.io/sms. A business registered for texting in its own name also has its own program page, terms and privacy notice on temaro.io, linked from its forms.
What you'll receive. Customer care messages about your project with that business: replies to your inquiry, a follow-up if you called and the call was missed, links to quotes and invoices, appointment confirmations and reminders, job updates, and occasional review requests or check-ins after a job.
How you agree. You opt in by checking the optional, unchecked box on a business's Project Intake form or online booking page, by tapping "Yes, text me" on the personal opt-in page a business sends you, by texting the business first, or by telling the business directly (in person, by phone or on its own paper form), which it then records. Consent to receive texts is not a condition of any purchase.
Frequency and cost. Message frequency varies. Message and data rates may apply.
Stopping and help. Reply STOP to any message to opt out; you will receive one confirmation text and no further messages from that number. Reply START to opt back in. Reply HELP for help, or email admin@temaro.io.
Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or your texting consent with third parties for their marketing or promotional purposes; see our Privacy Policy for details.
You can add team members to your account. Office seats can see and do what you allow; crew seats see only their own assigned jobs. When you assign work to a crew member, Temaro can text them from your business number — the job details, a morning schedule, and alerts — and records when they tap On my way, On site and Completed, any time off they mark, the hours those taps add up to, and photos they upload from a job, labelled with their name. You confirm that each person you add has agreed to receive work texts from your business at the number you enter, and you are responsible for complying with any law that applies to how you schedule, track or photograph your workers and their work. Photos your crew take at a customer's property are your responsibility: take them with the customer's knowledge, keep them to the work itself, and do not include people without their permission. Removing a team member ends their access immediately.
You agree to indemnify, defend, and hold harmless Temaro, its owners, and its personnel from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) your violation of these terms; (c) your violation of any law, including the TCPA or other telecommunications or consumer protection law; (d) any content, data, or information you submit, upload, or transmit through Temaro; or (e) any dispute between you and your own customers.
Temaro and its software, design, and branding are our property. You retain ownership of the customer, quote, invoice, appointment, message, photo and team data you and your team enter into the platform, and you can export your customers, quotes and invoices from Settings at any time. You grant us a limited license to host, process, and transmit that data solely as needed to operate the service for you, and you represent that you have the right to submit that data and content to us.
Some features (such as voicemail transcription, AI-drafted lead summaries, quote drafts, suggested appointment times, and Tempe's drafted replies to your customers) use automated and AI-assisted processing. This output may be inaccurate or incomplete. You should review AI-generated content before relying on it or acting on it, and we are not liable for decisions made based on inaccurate automated output.
You control how much Tempe does on its own through the settings in your account. By default Tempe only drafts, and a person at your business sends. If you choose to let Tempe send replies, quotes, appointment confirmations, follow-ups or picture messages automatically, those messages are sent from your business number in your name and you are responsible for them as if you had sent them yourself, including for their accuracy and for your customers' consent to receive them. Tempe quotes prices only from the price list you write and offers only appointment times that are open on your calendar; you are responsible for keeping both accurate.
Each plan includes a monthly amount of text messaging and, on plans that include Tempe, a monthly amount of AI activity. The current amounts are shown in Settings → Billing. When a business reaches its monthly amount, automatic messages and Tempe's automatic actions pause until the next month, a top-up pack, or an upgrade; missed-call replies, quotes, invoices and alerts to you continue. Picture messages have a separate monthly limit. We may also pause a business's sending temporarily when carriers report its messages as unwanted. Until a business's own texting registration is approved, its texts are sent under Temaro's shared registration, so complaints about one business can affect others; once it is approved, they are sent under the business's own registration, which carriers can still filter or suspend. We will tell you when any of this happens.
You may upload photos of your own finished work for Tempe to send to customers who ask. You confirm that you own or have the right to use each photo, that it shows your own work, and that it does not show people or private information about a customer or their property without that customer's permission.
Temaro relies on third-party providers — including Twilio for messaging and calling, Stripe for payments, Cloudflare for photo storage, Resend for email, Anthropic for Tempe's AI processing, Google Maps for satellite measuring, and our database hosting provider for secure data storage — to operate. Your use of Temaro is also subject to the acceptable use policies of these providers. We are not responsible for outages, errors, or data loss caused by these third-party providers, and we do not guarantee their availability.
Temaro is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. You use Temaro at your own risk.
To the maximum extent permitted by law, Temaro will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of the service — regardless of the legal theory (contract, tort, negligence, or otherwise) and even if we've been advised of the possibility of such damages. Our total aggregate liability arising from or related to these terms or your use of Temaro will not exceed the amount you paid us in the 12 months before the claim arose. These limitations apply to the fullest extent permitted by applicable law.
We may suspend or terminate your access to Temaro at any time, with or without notice, if we reasonably believe you've violated these terms, your account poses a security or legal risk, or your payment fails and is not cured within a reasonable period. You may cancel your account at any time as described above. Sections of these terms that by their nature should survive termination — including Indemnification, Disclaimer of Warranties, Limitation of Liability, and Dispute Resolution — will survive.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages at third-party providers, natural disasters, acts of government, labor disputes, or internet or telecommunications failures.
Any dispute arising from these terms will be resolved through binding arbitration in Arkansas, except that either party may bring an individual claim in small claims court. You and Temaro each waive the right to a jury trial and to participate in a class action or class arbitration. Any claim must be brought within one year after it arises, or it is permanently barred.
These terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-laws principles, and venue for any court proceeding not subject to arbitration will be in Arkansas.
You may not assign or transfer these terms or your account without our prior written consent. We may assign these terms in connection with a merger, acquisition, or sale of assets without your consent.
If any provision of these terms is found unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be interpreted to best accomplish its original intent. Our failure to enforce any provision is not a waiver of our right to do so later. These terms, together with our Privacy Policy, are the entire agreement between you and Temaro regarding the service.
We may update these terms from time to time. Continued use of Temaro after changes constitutes acceptance of the updated terms.
